Open Missouri is a project of the Donald W. Reynolds Journalism Institute at the Missouri School of Journalism in Columbia, Mo. Open Missouri aims to empower citizens and journalists by helping them find and obtain computerized information collected by state and local government agencies. In addition, we serve as a platform for people who want to share this information. We need you to thrive, so we really hope you use this site and become a member of our community.
Please read this Terms of Service agreement (the “Agreement”) carefully because it is a contract between you and the Open Missouri website (the “Website”) that governs your use of the Website and all of the content on it, regardless if you are a visitor or choose to join the Open Missouri community.
By visiting the Website you signify that you have read, understand and agree to be bound by the terms. By accessing or using the Website, you also represent that you have the legal authority to accept the terms on behalf of yourself and any party you represent. If you do not agree to these terms, you are not authorized to use the Website.
From time to time we may change this Agreement at our sole discretion. By visiting the Website after these changes have been made, you are consenting to these changes. Check this section from time to time so you are informed of any potential changes.
Conduct, contributions, comment and content
Open Missouri is a moderated community for the most part. We strive to provide accurate information about databases, so we review and edit information submitted by community members before we post that information. Despite these best efforts, we cannot be responsible for any errors or incomplete information, or any effects. You are responsible for taking precautions necessary to protect yourself and your computer systems from viruses, Trojan horses, malware and other harmful content.
We have not reviewed all of the material made available by external links on the Website. Open Missouri does not have control of those external sites and is not responsible for their contents or use. We do not imply that we are endorsing the sites to which we are linking. You are responsible for taking protections against harmful computer content, such as viruses.
It is a violation of this Agreement to use information from the Website to send unsolicited information to harass, abuse or harm another person. Likewise, it is a violation to use information from this Website to advertise, sell or solicit to any user without their prior consent.
It is a violation to the Agreement to submit content that is obscene, illegal, defamatory, threatening, infringes on intellectual property rights, invades privacy, or is otherwise harmful or objectionable. Open Missouri reserves the right to delete any of this material.
In addition, it is a violation of this agreement to submit content that contains computer viruses, Trojan horses or other malware, or to submit information that the user knows is inaccurate.
If you create an account on the Website, you are responsible to maintaining the security of it and your login information, including password. You are fully responsible for any activities that occur under the account.
Copyright infringement and DMCA policy
We ask that you respect the intellectual property rights of Open Missouri and of others. If you believe that material on the Website violates your copyright, please contact us pursuant to our DMCA agreement. We will respond to all such notices and remove or remove links to infringing material. We reserve the right to delete the user accounts of repeat infringers. Open Missouri may terminate your access to all or any part of the Website at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate this Agreement or your account (if you have one), you may simply discontinue using the Website. All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
Disclaimer of Warranties.
The Website is provided “as is”. Open Missouri and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither Open Missouri nor its suppliers and licensors, makes any warranty that the Website will be error free or that access thereto will be continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through, the Website at your own discretion and risk.
Limitation of Liability
In no event will Open Missouri, or its suppliers or licensors, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement or substitute products or services; (iii) for interruption of use or loss or corruption of data; or (iv) for any amounts that exceed the fees paid by you to Open Missouri under this agreement during the twelve (12) month period prior to the cause of action. Open Missouri shall have no liability for any failure or delay due to matters beyond their reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.
General Representation and Warranty
You agree to indemnify and hold harmless Open Missouri, its contractors, and its licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of the Website, including but not limited to your violation of this Agreement.
This Agreement constitutes the entire agreement between Open Missouri and you concerning the subject matter hereof, and they may only be modified by a written amendment signed by an authorized executive of Open Missouri, or by the posting by Open Missouri of a revised version. Except to the extent applicable law, if any, provides otherwise, this Agreement, any access to or use of the Website will be governed by the laws of the state of Missouri, U.S.A., excluding its conflict of law provisions, and the proper venue for any disputes arising out of or relating to any of the same will be the state and federal courts located in Boone County, Missouri.
